|Description:||Some recent studies and reports indicate that being sued by our own employees is more likely than by a civilian plaintiff. The jury awards and settlements in these retaliation claims frequently are much higher that those brought by citizens involving police encounters.
Employee retaliation claims present many issues for the public safety agency. They can create internal conflicts and dysfunction for the agency. They may indicate deeper issues of supervisory and disciplinary problems. They can be tricky when it comes to family medical leave, First Amendment rights, harassment, discrimination and disparate disciplinary treatment.
